Concerning the Qatari Flag

 

Law No. 14 of 2012 Concerning the Qatari Flag

We, Hamad bin Khalifa Al-Thani, Emir of the State of Qatar,
Having perused the Constitution,
Qatar Penal Code promulgated by Law No. 11 of 2004, as amended,
Emiri Resolution No. 10 of 2006 concerning the reorganisation of the Emiri Diwan and the specification of its functions, and amending Emiri resolutions,
The proposal of the President of the Emiri Diwan,
The draft law submitted by the Council of Ministers, and
Having taken the opinion of the Shura Council,
Hereby promulgate the following law: 

 

 

Articles

 

Article 1

The national flag of the State of Qatar shall be, in terms of shape, design, colours, size, materials, configuration and performance requirements, according to the specifications set forth in Annex No. 1 attached hereto.
The flag of the Emir shall be according to the specifications set forth in Annex No. 1 attached hereto.
 
 

 


Article 2

 

The form and specifications of the flags of the branches of the main units of the Armed Forces, the terms and conditions of use and the due respect and reverence towards them, shall be determined by a decision of the Supreme Commander of the Armed Forces.
 

 


Article 3

 

The Qatari flag shall be respected and treated with dignity as a symbol of the State, and must not be subjected to mistreatment in any way.

 


Article 4

 

where a Qatari flag is damaged, torn, worn-out, or its colours become faded, or where it appears in any way inappropriate, it shall not be flown, or displayed, or circulated.

 


Article 5

 

The use of the Qatari flag for purposes contrary to the original purpose of its use, or the addition of any words or pictures or designs thereto, or its use for commercial purposes, or as a brand or a part thereof, or for the purpose of advertising shall be prohibited.

 


Article 6

 

The protocol for the use of the Qatari flag, including the conditions and rules for flying the flag at the finial and at half-mast, shall be in accordance with the rules, conditions and procedures set forth in Annex No. 2 attached hereto.

 


Article 7

 

The Qatari flag shall be saluted by the military when it is flown at the finial and at half-mast, and during military parades.
      

 


Article 8

 

Without prejudice to any more severe penalty provided for by law, any person who deliberately insults the Qatari flag  by damaging it, or removing it from where it is raised, or by any act or omission expresses contempt or hatred or lack of due respect for the flag shall be punished by imprisonment for a term not exceeding three (3) years and a fine not exceeding Two Hundred Thousand (200,000) Riyals, or either of them.

 


Article 9

 

Without prejudice to any more severe penalty provided for by legislation, any person who commits any of the acts listed in this Article shall be punished by imprisonment for a term not exceeding six months, and a fine not exceeding One Hundred Thousand (100,000) Riyals, or either of them:
 
1.      Violation of any of the provisions of Articles 3 and 4 of this Law;
2.      Sale, offering for sale, or trading in the Qatari flag in violation of the specifications set forth in this Law or in violation of any decisions issued in the implementation thereof;
3.      Raising or flying at half-mast, or using the Qatari flag in violation of the provisions of this Law and its executive decisions.
 

 


Article 10

 

The Chairman of the Emiri Diwan shall determine the competent administrative unit in all matters relating to the application and implementation of the provisions of this Law and ensure compliance with its provisions.
 

 


Article 11

 

The concerned government agencies, each in its respective areas, in coordination with the competent administrative unit referred to in Article 10 shall issue licences for the manufacture, importing and sale of the Qatari flag in accordance with the specifications set forth in this Law.
 

 


Article 12

 

By a decision of the Emir, Annexes 1 and 2 attached hereto may be amended.

 


Article 13

 

The President of the Emiri Diwan shall issue the decisions necessary for the implementation of the provisions of this Law.

 


Article 14

 

All competent authorities, each in their respective jurisdiction, shall enforce this Resolution from the date of its publication in the Official Gazette.
